Senator Moran and 50 Senators: Second Amendment Rights are not Negotiable

U.S. Senator Jerry Moran (R-KS) today led 50 senators in expressing grave concern about the dangers posed to Americans’ Second Amendment rights by the United Nations’ Arms Trade Treaty. The 51 senators notified President Obama and Secretary of State Clinton of their intent to oppose ratification of an Arms Trade Treaty that in any way restricts the rights of law-abiding American gun owners. The opposition is strong enough to block the treaty from Senate passage, as treaties submitted to the U.S. Senate require approval of two-thirds of Senators present to be ratified.

I guess it is that amount. I thought I read a while back in one of the NRA newsletters that the count was much higher. Anyway is good to see them sticking together.

Epic Fail: U.N. Arms Trade Treaty Fizzles Out

The Conference on the United Nations Arms Trade Treaty (U.N. ATT) has broken down and will not report a draft treaty to the member nations. This is a big victory for American gun owners, and the NRA is being widely credited for killing the U.N. ATT.

NRA worked with pro-gun allies in the U.S. Congress and successfully assembled strong bipartisan opposition to any treaty that adversely impacts the Second Amendment. On two occasions NRA was successful in convincing a majority of the U.S. Senate to sign letters to President Obama that made it clear that any treaty that included civilian arms was not going to be ratified by the U.S. Senate.

On July 26, Sen. Jerry Moran (R-Kan.) gathered the signatures of 51 Senators on a letter to President Obama and Secretary of State Clinton opposing any treaty that infringes on domestic gun rights. The letter stated, “As the treaty process continues, we strongly encourage your administration not only to uphold our country’s constitutional protections of civilian firearms ownership, but to ensure — if necessary, by breaking consensus at the July conference — that the treaty will explicitly recognize the legitimacy of lawful activities associated with firearms, including but not limited to the right of self-defense. As members of the United States Senate, we will oppose the ratification of any Arms Trade Treaty that falls short of this standard.”

During the week leading up to the impasse, it became increasingly possible that the Conference would fail to come to an agreement on draft language. On Thursday, the Conference President produced yet another draft of the ATT in an effort to salvage the process. The new draft, like previous ones, was wholly incompatible with Second Amendment rights protected by the Constitution.

Details of the Composite ‘Working Document’ were released on July 24. The draft barred weapons transfers to “non-state actors” – which, by definition, include private citizens. A U.S. delegate argued against the provisions during closed-door talks Friday. Also, proponents said the first draft of the U.N. treaty had “more holes than a leaky bucket.”

Arms treaty negotiations fail in U.N.

(AP) UNITED NATIONS - A U.N. treaty to regulate the multibillion-dollar global arms trade will have to wait after member states failed to an reach agreement, and some diplomats and supporters blamed the United States for the unraveling of the month-long negotiating conference.

Hopes had been raised that agreement could be reached on a revised treaty text that closed some major loopholes by Friday's deadline for action. But the U.S. announced Friday morning that it needed more time to consider the proposed treaty; and Russia and China then also asked for more time.

"This was stunning cowardice by the Obama administration, which at the last minute did an about-face and scuttled progress toward a global arms treaty, just as it reached the finish line," said Suzanne Nossel, executive director of Amnesty International USA. "It's a staggering abdication of leadership by the world's largest exporter of conventional weapons to pull the plug on the talks just as they were nearing an historic breakthrough."

A Western diplomat, speaking on condition of anonymity because of the sensitivity of the issue, also blamed the U.S., saying "they derailed the process," adding that nothing will happen to revive negotiations until after the U.S. presidential election in November.

Chief U.S. negotiator Thomas Countryman refused to talk to several dozen reporters when the meeting broke up.

U.S. State Department spokeswoman Victoria Nuland said in a statement Friday evening that the U.S. supports a second round of negotiations next year.

"While we sought to conclude the month's negotiations with a treaty, more time is a reasonable request for such a complex and critical issue," the statement said.

The draft treaty would require all countries to establish national regulations to control the transfer of conventional arms and to regulate arms brokers. It would prohibit states that ratify the treaty from transferring conventional weapons if they would violate arms embargoes or if they would promote acts of genocide, crimes against humanity or war crimes.

In considering whether to authorize the export of arms, the draft says a country must evaluate whether the weapon would be used to violate international human rights or humanitarian laws or be used by terrorists, organized crime or for corrupt practices.

Many countries, including the U.S., control arms exports but there has never been an international treaty regulating the estimated $60 billion global arms trade. For more than a decade, activists and some governments have been pushing for international rules to try to keep illicit weapons out of the hands of terrorists, insurgent fighters and organized crime.

U.N. Secretary-General Ban Ki-moon said he was "disappointed" with the failure to reach agreement on a treaty text, which he described as "a setback." He said he remained committed to working with member states to peruse a "robust" treaty on controlling the conventional arms trade.

BEWARE!!!

Repeated comments about the temporary hold asked for by several member nations only means that for the time being the issue is placed on hold and will resurface after the elections. If we elect this scumbag to another term, we will be faced with more and stronger opposition to gun rights and the Second Amendment!!! PAY ATTENTION BECAUSE THIS IS STILL A REALLY IMPORTANT ISSUE THAT HAS NOT GONE AWAY!!!
